The New Partner Visa Changes: What You Need to Know

In 2021, the Australian Government had confirmed that new changes to partner visas would be implemented in November. The government didn’t follow through with this change as expected. However, it could happen this month- February 2022.

 If your current visa is expiring soon and you intend to apply for a partner visa, act now before time runs out!

WHY THE NEW PARTNER VISA CHANGES COULD HAVE A DISASTROUS OUTCOME TO YOUR PLANS TO STAY IN AUSTRALIA?

An application for a partner visa is done in two steps:

  • Applicant application
  • Sponsor application

The process of applying for a visa is done with an applicant application first, which is then followed by the sponsor’s application.

So far, you don’t need to get the “sponsor application” approved first.

But that’s about to change.

IN THE COMING MONTHS, SPONSORS WILL NEED TO BE APPROVED BEFORE THEIR PARTNERS ARE ELIGIBLE FOR A PARTNER VISA.

If your visa is expiring within a year from now, you could be in trouble if you want to apply for a partner visa onshore. 

Let’s say that after lodging the sponsorship application with Home Affairs, they don’t make any decision on the matter and 7 months pass. 

In this case, your current visa expires–you will then find yourself illegal in Australia and unable to reapply for an Australian Partner Visa.

AT THE MOMENT, ELIGIBLE APPLICANTS WANT TO LODGE THEIR PARTNER VISA APPLICATIONS QUICKLY, BEFORE THE NEW CHANGES COME INTO EFFECT…

At the moment partner visas don’t require applicants to have a functional level of English – but this is about to change in the next month or so. 

Visa applicants and their sponsors need to be able to provide evidence that they speak a functional level of English in order for their application not be refused.
