What are the key differences between an offshore and onshore partner visa?

An offshore visa application means you apply for an Australian visa while you are outside the country. You should be outside the country when your visa is granted.

If you are within Australia and you apply for a partner visa, it is an onshore application. To be granted the visa, you must be in Australia both when you make the application and when it is granted.

If you apply for your visa whilst onshore, you will be issued a Bridging visa. This allows you to remain in Australia while your application is being processed. It is important to review your visa conditions as some Bridging Visas do not allow for work rights and can impose various other restrictions.

1. Onshore Partner Visa

If you’re the partner or spouse of an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen, you can apply for a Partner Visa (subclass 820 and 801) while you are still in Australia.

One of the requirements for the visa is addressed clearly in the literature as follows:

“You must be in Australia when you apply for this visa and when we decide your temporary visa application. Family who applies with you must also be in Australia.”

2. Offshore Partner Visa

Partner Visa (subclass 309 and 100) allows the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to apply for while they are outside of Australia.
