Great news for Temporary Migration Workers: Introducing the Workplace Justice Visa

We are excited to share an important update that reinforces Australia‘s commitment to protecting temporary migrants from workplace exploitation. The Migration Amendment (Workplace Justice Visa) Regulations 2024 introduces a new stream to Subclass 408, providing essential support and protection for those who have faced workplace exploitation.

 

Key Features of the Workplace Justice Visa:

 

  • Stay and Work: Visa holders can remain in Australia to resolve workplace issues and continue working during this period.

  • Certification Requirement: Applicants need certification from authorized entities to qualify.

  • Pilot Program: The visa will be launched as a pilot, with close monitoring to ensure its effectiveness and integrity.

How to Report Workplace Exploitation:

  • Fair Work Ombudsman: Call 13 13 94 or complete an anonymous online report.

  • Border Watch: Reports can also be made anonymously.

Employer Limitations:

  • Employers cannot cancel or change visa conditions. Only the Department of Home Affairs, including the Australian Border Force, can make decisions about visa status.

Checking Visa Conditions:

  • Use the free Visa Entitlement Verification Online (VEVO) system or download the myVEVO app to check visa conditions, including work rights and expiry dates.
